Colorado Courts Follow Florida Case History for Handling Child Therapists

Attorney James S. Margulis, now practicing at Cantafio and Song, PLLC in Denver, Colorado, has been cited and his representation revisited when it comes to the matter of Family Law, Divorce, and using a child's therapist as a witness. So often, in the pursuit of the best interest of the child(ren) in divorce cases, one or both parents will seek to call the child's therapist as a witness. However, the paramount concern is that any such testimony would destroy the therapeutic relationship.

Jim Margulis explored and successfully argued this issue in 2001, but it is still a relevant matter that is currently being discussed in today's Colorado cases. In short, "Where the parents are involved in litigation themselves over the best interests of the child, the parents may not either assert or waive the privilege on their child's behalf" see Attorney ad Litem v. Parents of D.K., 780 So. 2d 301, 307 (Fla. Dist. Ct. App. 2001. Mr. Margulis' success in preserving the child/therapist relationship is a victory for not only child protection but also in the domestic family law arena.
