Adoption

Whether a new parent adoption, step parent adoption or grandparent adoption, there is a great deal of paper work and back ground checks from various agencies that must be done properly before the Court will ever sign orders for adoption. In addition to making sure all of the paper work is done completely and accurately, the Family Law attorneys of Feldmann Nagel, LLC, will work to make this joyous occasion as easy as possible for you and your family.

Divorce

When two people decide to end their marriage or commitment, there are many issues to resolve. Most often there are children involved and parenting time and decision-making responsibilities must be determined. There is also the allocation of debts and assets in an equitable fashion. Depending on the division of property and debt, there may be cause for one party to seek maintenance, previously known as alimony, from the other party as well.

With so many issues to resolve and decisions to make, you need counsel that is well versed in the law as well as attentive to your needs and goals for the process. Feldmann Nagel, LLC works to assist you in resolving the issues outside of the courtroom, while having the confidence and experience to take your case to trial to advocate for your best interests if necessary.

Collaborative Divorce

Collaborative Divorce is a fairly new model of divorce law that keeps your case out of the Court room completely, and attempts to resolve your issues with a team approach instead of an adversarial approach. While both parties have separate attorneys to legally advise him or her, and to advocate for his or her best interests, the attorneys and parties attempt to work as a team to determine the best parenting plan, and asset/debt division for the family. When the parties are better able to determine the outcomes for their family there is less likelihood of returning to Court for post decree issues.  To learn more about Collaborative Divorce, please view this PowerPoint presentation.

Legal Separation

Sometimes parties are not quite sure that they want a divorce and instead choose to separate for awhile. When the parties file for a legal separation with the Court, they attempt sever their financial obligations and if necessary, determine a parenting plan. If the parties later decide to reconcile, the legal separation can be withdrawn. If the parties decide to divorce, paperwork can be filed to convert the separation to a formal dissolution of marriage. Feldmann Nagel, LLC will provide the legal support and counsel necessary during this uncertain time and work to make sure you are legally protected.

Prenuptial Agreements

A prenuptial agreement, is a written contract between the parties that predetermines the financial outcome should their marriage or civil union end. With people getting married or entering partnerships later in life, or entering second marriages with children involved, and the increase in people owning their own homes and businesses when entering into marriage or a civil union - not to mention the overwhelmingly high divorce rate in this country- everyone should have a prenuptial agreement.

Why not decide how matters should be resolved fairly when you are most in love and committed to one another instead of waiting until anger or the tragedies of life arise? Why not discuss what will be marital assets AND debts before you commit to one another. Why not plan out and thoroughly discuss your financial future before it becomes the reality?

A Prenuptial Agreement isn't giving you an out or preparing for the worst as some cynics would say. It is marital insurance. It is an instrument for a discussion of the better and the worse. It is the proactive approach to a happy and stable partnership or marriage.

Paternity

An action for paternity is a legal determination from the Court to establish who the child's biological father is. In Colorado, there is a presumption of paternity if the parties are married or if an individual's name appears on the birth certificate. To contest or establish paternity a motion is filed with the Court requesting that genetic testing occur with the child or children and the alleged father. Actions for paternity are often important for establishing child support.

In other instances, the State may initiate an action for child support. An obligor for sake of child support may request a paternity test if he is not certain the child of the petition is not his.

Custody

Custody in Colorado, is now referred to as the allocation of parental responsibilities. In divorce and separation matters, the parties must determine the allocation of decision-making responsibilities and residential responsibilities. Decision-making usually includes educational, medical, religious and extra-curricular/recreational decisions. Residential responsibility is the determination of where the child or children will live for what periods of time. Once the Court enters orders for the allocation of parental responsibility they are difficult to modify. Feldmann Nagel, LLC works to help you get this right the first time while making sure the best interests of the children are protected, as this is the standard for the Court to enter orders for allocation of parental responsibility.

Child Support

Child Support is a legislatively calculated amount of money paid by one parent to the other based on the income of the parties and the number of overnights they each have with the child or children. Child Support may be modified upon the showing of a 10% or more change in the circumstances of either party. Whether a party has an increase in his or her income, or the number of overnights changes for either party, it may be time to ask the Court to modify the order for child support. Modifications can occur by stipulation of the parties, or through order of the Court upon the filing of a motion for modification and possibly a hearing on the matter with the Court.

Post Decree Matters

After the Court has entered its orders for the dissolution of marriage, the allocation of parental responsibility, and/or child support, things may change necessitating a modification of the court's orders. These matters are known as post decree matters. No matter how old or how recent the court orders are, Feldmann Nagel, LLC can initiate a modification to request new orders that will be better for you and your family.
